The Firm handled an appeal to the United States Court of Appeals for the 11th Circuit involving a question of first impression under Florida's Uniform Commercial Code. The issue on appeal was whether lost profits were recoverable under a contract terminable-at-will if the terminating party did not give reasonable notice. A copy of the opinion can be found here.

Once again, Roy Fitzgerald has authored two chapters in The Florida Bar publication Business Litigation in Florida (5th ed. 2007). He authored Chapter 9, "Proposals for Settlement," and Chapter 12, "Select Problems in Evidence." Previously, he authored the same chapters in the Third Edition in 1998 and the Fourth Edition in 2001.
